Adult Adoptions: Formalize a parent-child relationship, may affect inheritance

Guardian ad Litem (GAL) in Child Custody Cases

Agreed to by the parents or appointed by a court to represent the best interests of a child in child custody or divorce proceedings. 

 

A child’s wishes will be taken into consideration. 

 

Recommendations may include: Parenting Time, School, Activities, Therapy, Evaluations, etc.

 

Estate Planning: Wills, Power of Attorney, and Living Wills

A General Durable Power of Attorney appoints someone to handle your financial affairs. 

 

A Durable Medical Power of Attorney appoints someone to make medical decisions for you, only if your doctor says that you are unable to make your own medical decisions. 

 

A Living Will is a legal document that expresses your preferences and directions for life-sustaining procedures. 

 

A Will expresses how finances should be managed after passing away and may also name who should care for children if a guardian passes away.

Help for DCPP (DYFS) Caregivers

Taking care of a child in a Division of Child Protection and Permanency Case? Foster parents and family members are often caught in the middle, trying to assist a child but left with no one to talk to about the process.

 

The Court, Caseworker, Deputy Attorney General, Law Guardians, CASA and the parents’ attorney cannot provide resource parents (foster parents) and family members with legal advice in DCPP matters. Roth-Gutman Law is here to help support you and the best interest of the child(ren).

Guardianship of an Adult

If your child is disabled and is 18 years old or older, in order to continue to make medical, legal and financial decisions, a parent or interested person needs to file for Guardianship.  A guardian is appointed when someone can no longer make critical personal or financial decisions for themselves.
